1 is wrong. On question 2, while I do not know Georgia law, misdemeanors in most cases can carry a jail term of less than one year if imposed at all. If Georgia law requires a minimum sentence of one year in all cases, then you're right, but make sure.

A misdemeanor, by definition, is less serious than a felony. Look up the word "misdemeanor."
