Why can't the ozone layer be higher in the atmosphere?

Thanks, I have already read through a lot of these sites. I guess what I really need to understand is why can't oxygen survive at the higher levels? Because it is produced by the blue green algae, does this mean that it just can't travel far enough or does the temperature have an effect?
