What is the best way to contain the abuse of authority?

Instead of concentrating powers in one body, they are distributed among several bodies.
During their daily operations, they can feel their limitations. Once they act beyond their
limitations, they are stopped by other bodies.
i) Separation of Power and Performance of the State’s Functions
The principle of separation of powers should not be interpreted as a boundary between
the state organs or as a monopoly of a given function in the hands of one authority.
Indeed, as it was above mentioned, three functions must be performed:
 It should establish valid rules of social life that are applicable to all; this is the legislative
function;
 The law must be effectively enforced, if necessary, by force: this is the executive
function

I. Uburyo bwiza bwo gukumira abuswanyaga bw'ubuyobozi

Ahubwo yo gushyira ubushobozi bwinshi mu kigo kimwe, bukabikwa mu bigo bitandukanye. Mu bikorwa byabo bya buri munsi, bashobora kumva ibikwiye kugenderwaho. Iyo banyijwe byo kurenga ku mbibi zabo, barahagarikwa n'ibindi bigo.

i) Gutandukanya Imirimo no Gushyira mu bikorwa Imirimo y’Igihugu

Itegeko ryo gutandukanya imirimo ntiyagombye gusobanurwa nk'ikibanza kiri hagati y'ibikorwa by'igihugu cyangwa nk'uburenganzira bw'umugambi mu maboko y'ubuyobozi bumwe. Mu by'ukuri, nk'uko byavuzwe haruguru, imirimo itatu igomba gushyirwa mu bikorwa:

  • Ugomba gushyiraho amategeko akora ku mibereho ya sosiyete ashobora gukurikizwa na bose; iyi ni imirimo y'itegeko;
  • Amategeko agomba gushyirwa mu bikorwa neza, igihe cyose bikenewe, hakoreshejwe imbaraga: iyi ni imirimo y'ubuyobozi.
