thats where im lost I know that legislature is the one whom decides the length of a sentence for certain ccrimes.
The judge decides the sentence, based on state law. If the law mandates a sentence between 1 and 5 years for a specific crime, the judge takes mitigating factors (age, previous record, etc.) into consideration in sentencing a specific individual.
