The question is, States in which property accumulated during marriage is considered equally owned by both spouses are known as:
A. no-fault jurisdictions
B. joint custody jurisdictions
C. equitably property jurisdictions
D. community property jurisdictions
I am stuck on C and D. My book says that most states have laws intended to assure equitable distribution of marital property when a couple divorces. Equitable distribution laws allow judges to distribute property equitably, or fairly, between a husband and wife, regardless of who has title to the property.
Then another page says, In community property states, each spouse is said to own a one-half interest in property acquired during the marriage. Property owned before marriage or received as a gift remains separate property unless it is commingled with community property or treated as such.
So I wanted to go with D. after I read that but wanted to make sure. Check my answer please?
