“An investigation of whether the land restitution programme in South Africa promote equality”
Research problem.
Land restitution refers to “giving back” the land or “paying back” the people whose land was dispossessed after 1913. The restoration of land rights refers to the restitution of the land or a portion of land that was taken away after June 19,1913 due to previous legislation or practices that discriminated against certain races. Over a six-year period, over one million hectares of 86 million hectares of farmland owned by white South Africans were redistributed to black South Africans through land restitution and redistribution. Of the 554 individuals who benefited from the 2020 redistribution program, just 116 were female. While the Restitution of Land Rights Act 22 of 1994 outlines the procedure for land restitution, there have been instances where women will experience discrimination when it comes to access to the land. The main focus of this research is to address the issue of unequal access to land between women and men. In a democracy, it is critical to protect property rights and the rule of law. Restitution of land should follow the law and the constitution, and it should be done in a fair and just manner. In order to advance social justice, equality and peace in South Africa, it is imperative that the issue of unequal land restitution be addressed.

Method:
This research will utilize a mixed-methods approach, including both qualitative and quantitative data collection methods. Qualitative methods such as interviews and focus groups will be conducted with individuals involved in the land restitution program, including government officials, beneficiaries, and community members. These interviews will help provide a deeper understanding of the experiences and perspectives of individuals involved in the land restitution process. Quantitative data will also be collected through surveys to gather information on the demographics of beneficiaries, the amount of land redistributed, and any disparities that may exist between men and women in terms of land access.

Theoretical approach:
This research will be guided by critical feminist theory, which seeks to understand and challenge power structures and inequalities within society. The research will examine how gender dynamics play a role in access to land through the restitution program, and will seek to identify any systemic barriers that may be preventing women from accessing land. By using a feminist lens, this research aims to promote gender equality and social justice within the context of land restitution in South Africa.
