The “no-fault scheme” has been recommend as an addendum to the current Civil Liability Act 2003 (QLD) in order to rectify the inconsistencies in the application of the act within the legal system. This will greatly reduce the time for providing appropriate compensation and lower litigation costs for patients. It will also eliminate any false claims of medical negligence made towards doctors, and enable them to undertake more complex procedure without fear of litigation. This will indirectly elevate the standard of care towards patients. Therefore, the “no-fault scheme” is a step in the right direction for the future of medical negligence.
