Adam Chandler, star pitcher for the Olney Jayhawks, was warming up in the bull pitches to a catcher, during game 3 of the World Series where they were facing their hated rivals the Texas Loudmouths. Throughout this warm-up, the Texas fans were being very crude and obnoxious, and heckling Chandler non-stop for several minutes. After he completed his warm-up, Chandler wound up as if to throw the ball at the catcher, but instead turned around and threw it at one the hecklers in the stand, Palmer Cortland. The ball traveled at about 80 miles per hour, passed through a wire fence protecting the spectators, and struck Cortland in the mouth, causing injury.
Cortland want to sue Chandler in tort. Would you recommend that is claim is one for an intentional tort or negligence, and why? Which specific tort do you believe Cortland should pursue.
