2. The First amendment is about Congress NOT MAKING A LAW ABRIDGING the right of the people peaceably to assemble. I am not aware of anything about public versus private property in the First Amendment, although there is case law on the subject. Obviously you are not allowed to hold a protest meeting in your neighbor's living room without permission. However when it is about a pipe under the Missouri River, it is not so clear. Overall I agree with your choice.
